Website terms of use
These terms cover your use of capekitchens.com.au. They're written in plain English and kept short. By using the site you agree to them. If you don't agree, please don't use the site — you're always welcome to call us instead.
The site is run by Cape Kitchens Pty Ltd (ABN 75 690 108 395, ACN 690 108 395), 34 Minchin Way, Margaret River WA 6285. "We", "us" and "our" mean Cape Kitchens.
1. Your kitchen job is covered by your contract
These terms are only about the website. They are not the terms for designing, supplying or installing a kitchen, laundry, benchtop or cabinets. Any job we do for you is governed by the proposal you accept and the contract you sign with us. If anything on this site differs from your signed contract, the contract wins.
2. Prices, budgets and information on the site
Everything on the site is general information to help you plan. In particular:
- Nothing on the site is an offer or a quote. Budget ranges, example prices and project descriptions are a guide only. We can only give you a price once we've seen your space and worked through a design with you, and that price is set out in a written proposal.
- Sending us an enquiry doesn't create a contract or commit either of us to anything.
- Photos show finished projects as they were on the day. Colours, finishes and grain look different on every screen, and materials vary naturally between batches — always check real samples before you choose.
- Products, ranges and appliances from our suppliers change. Something shown on the site may since have been discontinued or changed by the maker.
- We do our best to keep the site accurate and up to date, but it may contain errors or be out of date. Please don't rely on it alone for a decision — ask us.
3. Photos, designs and other content
The text, photos, drawings, designs, videos, logo and layout of this site belong to Cape Kitchens or are used with permission. You're welcome to look, share a link, and save or print pages for your own planning. Please don't copy, republish or use our photos, designs or content for any commercial purpose — including another business's website, social media or marketing — without our written permission.
Brand names and logos of the suppliers we work with (such as Polytec, SilkSurface, Kaboodle, Häfele and Franke) belong to those companies. Showing them doesn't mean they endorse this site.
Drawings, proposals and designs we prepare for you are shared for your project with us. How you can use them is covered by your proposal and contract.
4. Customer portal and the sample project
If you're our customer, we'll give you a private link to your project pages (your portal, proposal, drawings, selections and contract) at maud.capekitchens.com.au. Anyone who has the link can open those pages, so please treat it like a key: keep it to yourself and the people you choose to share it with. If you think someone else has your link, tell us and we'll issue a new one.
The sample project linked from this site is a made-up job for you to explore. It's read-only, and nothing you do in it is saved or sent to us.
5. Using the site properly
When you use the site, please don't:
- send us false information, or enquiries or applications in someone else's name;
- try to get into parts of the site, the portal or our systems you aren't meant to, or test them for weaknesses;
- upload anything harmful (like viruses) or send automated or bulk submissions through our forms;
- copy or scrape the site in bulk, or use it in a way that breaks the law or stops others using it.
We may block access or ignore submissions that break these rules.
6. Links to other websites
The site links to and shows content from other services, including Facebook, Instagram, Google Maps and our suppliers' websites. We don't control those sites and aren't responsible for their content or how they handle your information — their own terms and privacy policies apply.
7. Job ads
Job ads on our Careers page describe roles we're hiring for. They aren't an offer of employment, and we may change or close an ad at any time. How we handle your application is set out in our Privacy Policy.
8. Your rights under Australian Consumer Law
Nothing in these terms takes away any right you have under the Australian Consumer Law or any other law that can't be excluded. If you buy goods or services from us, you have consumer guarantees that our signed contract and the law protect — these terms don't limit them.
9. Our liability for the website
The website is free to use and is provided "as is". We can't promise it will always be available, error-free or free of viruses, and we may change or take down any part of it.
To the extent the law allows, we aren't liable for any loss or damage that comes from using the website or relying on its general information — for example, a purchase you make or a decision you take elsewhere based only on something you read here. Where the law implies a guarantee about the website that we can't exclude but can limit, our liability is limited to supplying the information again or paying the cost of having it supplied again.
This section is about the website only. Our responsibilities for any work we do for you are set out in your contract and under the Australian Consumer Law.
10. Privacy, changes and the law that applies
Our Privacy Policy explains how we handle personal information you give us through the site.
We may update these terms from time to time by posting a new version here; the date at the bottom shows when they last changed. The version on the site when you use it is the one that applies.
These terms are governed by the law of Western Australia, and you and we agree that the courts of Western Australia can deal with any dispute about them.
